Welcome to Ponaloeat Game Studios, a premier mobile game development platform located at Sejong-daero 318, Daegu, South Korea. By accessing and using our website, mobile applications, and development services, you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you ("User," "Client," or "Developer") and Ponaloeat Game Studios ("Company," "we," "us," or "our"). Please read these Terms carefully before using our services.

Our services include but are not limited to: mobile game development, game design consultation, UI/UX design for gaming applications, cross-platform game development, and related digital entertainment solutions.

• Quality assurance and testing services
• Post-launch support and maintenance

Legal Compliance:

Users must comply with all applicable laws, regulations, and third-party agreements when using our services. This includes compliance with:

• Local and international gaming regulations
• App store guidelines (Apple App Store, Google Play Store)
• Privacy laws and data protection requirements
• Intellectual property rights and licensing requirements

Account Security:

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Notify us immediately of any unauthorized access or security breaches.

Our Intellectual Property:

All content, software, tools, methodologies, and proprietary technologies developed by Ponaloeat Game Studios remain our exclusive intellectual property. Users may not copy, modify, distribute, or create derivative works without explicit written permission.

Client Game Projects:

Unless otherwise specified in writing, all custom game development projects and associated intellectual property rights belong to the client upon full payment. We retain rights to general methodologies, tools, and frameworks used in development.

Third-Party Assets:

Users must provide proper licensing documentation for any third-party assets, graphics, music, or code incorporated into their games. We will not include unlicensed content in any development work.

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Handling:

• We collect only necessary information for service provision
• Data is stored securely with appropriate encryption measures
• Client project data is kept confidential and not shared with third parties
• Users have the right to access, modify, or delete their personal data

Development Timeline:

Project timelines are estimated based on initial requirements and may vary based on complexity, revisions, and scope changes. We will provide regular progress updates and communicate any potential delays promptly.

Service Availability:

Our platform operates 24/7, with development team availability Monday-Friday 9:00-18:00 KST. Emergency support may be available for existing clients during critical development phases.

Support Response Times:

• Critical issues: Within 4 hours (business days)
• General inquiries: Within 24 hours
• Development questions: Within 48 hours

Payment Structure:

• 50% deposit required to initiate development
• 25% payment upon alpha version delivery
• 25% payment upon final project completion
• All payments in USD or equivalent

Refund Policy:

Deposits are non-refundable after project initiation. Refunds for completed work may be considered on a case-by-case basis for defective deliverables. Digital game assets and code become non-refundable upon delivery.

Late Payments:

Projects may be suspended for payments overdue by more than 7 days. Additional charges may apply for payment delays and project rescheduling.

Our liability is limited to the amount paid for specific services. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Third-party integration failures or compatibility issues
• App store approval denials or removal
• Market performance or commercial success of developed games

Service Warranty:

We warrant that our development services will be performed in a professional manner. Any bugs or defects in initial delivery will be corrected at no additional charge within 30 days.

Termination by User:

Users may terminate their account or project at any time by providing written notice. Deposits paid are non-refundable, and users will receive all work completed up to the termination date.

Termination by Company:

We reserve the right to terminate or suspend services for:

• Violation of these Terms of Service
• Non-payment of fees
• Illegal or unethical use of services
• Abusive behavior toward our team

Data Retrieval:

Upon termination, clients have 30 days to retrieve their project data and assets. After this period, data may be permanently deleted from our systems.

These Terms are governed by the laws of the Republic of Korea. Any disputes arising from these Terms or use of our services shall be resolved through:

Dispute Resolution Process:

1. Direct negotiation between parties
2. Mediation through a neutral third party
3. Arbitration under Korean Commercial Arbitration Board rules
4. Court jurisdiction in Daegu, South Korea (if arbitration fails)

Language:

These Terms may be translated into Korean for convenience, but the English version shall prevail in case of any discrepancy.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Users are advised to review these Terms periodically.

Notification of Changes:

• Major changes will be communicated via email to registered users
• Effective dates will be clearly stated for new Terms
• Continued use constitutes acceptance of modified Terms
• Users may terminate accounts if they disagree with changes
